TERMS AND CONDITIONS OF SERVICE

Please read these Terms and Conditions carefully before ordering any products/services from CloudVPSHosting.app. All contracts that CloudVPSHosting.app may enter into, for the provision of services, shall be governed by these Terms and Conditions, and CloudVPSHosting.app will ask for your acceptance of these Terms if you use the https://cloudvpshosting.app/ website and purchase cloud VPS server services.
1. Introduction
1.1 These Terms & Conditions ("Terms") govern your use of CloudVPSHosting.app's VPS, dedicated server, and related cloud infrastructure services.
1.2 By ordering or using any services, you agree to be bound by these Terms.
1.3 CloudVPSHosting.app may amend these Terms from time to time; changes will be posted on the website, and continued use constitutes acceptance of the updated Terms.
2. Definitions
"Service" means cloud VPS, dedicated servers, managed hosting, or other infrastructure services provided by CloudVPSHosting.app.
"Customer" or "you" means the individual or entity ordering or using the Service.
"Hosted Data" means your files, databases, content, and configurations stored on CloudVPSHosting.app infrastructure.
"Contract" means the agreement formed by these Terms plus your order.
3. Account Setup
3.1 CloudVPSHosting.app will provision your server within the timeframe stated at checkout (typically under 60 seconds) once payment is confirmed.
3.2 You are solely responsible for configuring your server, migrating data, and securing your environment. We do not provide data migration services unless explicitly agreed.
3.3 You should test your server environment after setup and notify CloudVPSHosting.app of any platform issues within 7 days; after that, your approval will be assumed.
4. Cloud Services & Availability
4.1 CloudVPSHosting.app will provide the agreed cloud infrastructure services for the subscribed term (monthly, annually, etc.).
4.2 We target a 99.9% uptime SLA but do not guarantee 100% uninterrupted availability. Scheduled maintenance or emergency work may result in temporary downtime with advance notice where possible.
4.3 CloudVPSHosting.app may suspend or terminate services if you violate these Terms, fail to pay, or use servers for illegal purposes.
5. Payments & Billing
5.1 All fees must be paid in advance according to the pricing and billing cycle selected at checkout.
5.2 CloudVPSHosting.app will issue invoices; payment must be made by the due date to maintain uninterrupted service.
5.3 If payment is late, CloudVPSHosting.app reserves the right to suspend services until outstanding balances are settled.
5.4 No refunds will be issued for suspension caused by non-payment or Terms violations.
5.5 IP address allocations, domain registrations, and certain add-on services may be non-refundable once provisioned.
If the transaction or purchase feels suspicious by the billing team, then the team will request proofs to verify your identity. If you fail to respond or verify with the proofs within 24 hours, the particular products or services will be deleted from the account and it won't be eligible for the refund.
6. Data & Backups
6.1 You are responsible for maintaining your own backups. CloudVPSHosting.app may provide automated backup features as a convenience, but these are not a guaranteed data recovery service.
6.2 Upon termination, CloudVPSHosting.app will make Hosted Data available for download for up to 30 days, provided all outstanding fees are paid, after which data may be permanently deleted.
7. Acceptable Use & Content Restrictions
7.1 You must use the Service lawfully. Prohibited activities include spam, network abuse, DDoS attacks, cryptocurrency mining without prior approval, malware distribution, and copyright infringement.
7.2 CloudVPSHosting.app may suspend or terminate your service immediately if you engage in prohibited activities or host illegal content.
7.3 You are responsible for all activity on your server and indemnify CloudVPSHosting.app from any claims arising from your use of the Service.
8. Security & Malware
8.1 CloudVPSHosting.app provides network-level DDoS protection and infrastructure-level firewalls on all plans, but you are responsible for securing your server operating system and applications.
8.2 If malware, abuse, or hacking is detected, CloudVPSHosting.app may suspend the affected server and notify you to remediate. Repeated violations may result in termination.
8.3 You agree to cooperate with any investigation into security incidents or abuse originating from your server.
9. Confidentiality & Data Protection
9.1 CloudVPSHosting.app will keep your account and payment information confidential and will only disclose it to authorised service providers or if required by law.
9.2 Both parties agree to comply with applicable data protection laws, including GDPR where relevant.
9.3 CloudVPSHosting.app may use third-party sub-processors (e.g. data centres, payment processors) under binding confidentiality obligations.
10. Warranties & Disclaimers
10.1 CloudVPSHosting.app provides services "as is" and "as available."
10.2 We do not warrant uninterrupted, error-free, or completely secure operation of the Service.
10.3 You accept that you use the Service at your own risk.
10.4 To the extent permitted by law, CloudVPSHosting.app disclaims all implied warranties including merchantability and fitness for a particular purpose.
11. Limitation of Liability
11.1 CloudVPSHosting.app will not be liable for indirect, incidental, special, or consequential damages including loss of profits, loss of data, or business interruption.
11.2 Our maximum liability for any claim will not exceed the total fees paid by you in the 12 months preceding the claim.
11.3 Nothing in these Terms excludes liability for death or personal injury caused by our negligence.
11.4 CloudVPSHosting.app is not liable for delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, network failures, or government actions.
12. Indemnification
12.1 You agree to indemnify and hold CloudVPSHosting.app harmless from any claims, damages, or costs (including legal fees) arising from your breach of these Terms or your use of the Service.
12.2 CloudVPSHosting.app may, at its option, assume control of the defence of any claim for which indemnification is sought, at your expense.
13. Termination & Suspension
13.1 Either party may terminate by giving at least 30 days' written notice, expiring after the minimum term expires.
13.2 CloudVPSHosting.app may suspend or terminate services immediately for material breach, non-payment, illegal use, or abuse of infrastructure.
13.3 Upon termination, servers will be deprovisioned and Hosted Data may be permanently deleted after the 30-day data retention period.
14. Governing Law & Dispute Resolution
14.1 These Terms are governed by the laws of England & Wales.
14.2 Disputes should first be attempted to resolve informally by contacting support. If unresolved within 30 days, parties submit to the exclusive jurisdiction of the courts of England & Wales.
14.3 CloudVPSHosting.app may seek injunctive or other equitable relief in any jurisdiction as necessary to protect its rights.
15. Miscellaneous
15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.
15.2 You may not assign your rights or obligations under these Terms without CloudVPSHosting.app's prior written consent.
15.3 CloudVPSHosting.app may assign or transfer its rights and obligations at any time.
15.4 Failure by CloudVPSHosting.app to enforce any right under these Terms does not constitute a waiver of that right.
15.5 These Terms, together with any order confirmations, constitute the entire agreement between you and CloudVPSHosting.app for the Services.
